Provider, Contracting Parties & Scope
These Terms & Conditions apply to all cleaning services requested or booked via: website, email, phone, or WhatsApp.
The contractual provider is Omaidullah Stanikzai & Samiullah Stanikzai GbR, trading as 'EcoBrightClean'.
Cleaning services may be carried out by EcoBrightClean employees or independent partner cleaners (self-employed subcontractors) assigned by EcoBrightClean.
Customer terms do not apply unless explicitly accepted.
All Partner Cleaners assigned by EcoBrightClean are bound by these Terms and Conditions.
Definitions
Customer: Any natural or legal person who requests, books, or uses cleaning services via the platform, email, phone, or WhatsApp.
Service: Cleaning work in private or commercial premises.
Partner Cleaner: Self-employed subcontractor assigned by EcoBrightClean.
Platform: ecobrightclean.de
Booking: The Customer’s binding service request.
Booking Confirmation: The email from EcoBrightClean confirming acceptance and forming the contract.
Customer Account: Optional user account for managing bookings.
Review: Star rating submitted after the service.
Scope of Services
EcoBrightClean provides cleaning services according to the Customer’s booking.
Customers may request a preferred cleaner. EcoBrightClean will make reasonable efforts to accommodate this request but cannot guarantee the assignment of a specific cleaner.
Formation of Contract
Website content is non-binding and does not constitute a contractual offer.
By clicking 'book with payment,' the Customer submits a binding offer.
A contract is concluded only upon EcoBrightClean’s Booking Confirmation.
Automatic acknowledgment emails do not constitute acceptance.
Customer Responsibilities
Providing timely access (opening the door, providing keys, codes).
Ensuring running water and electricity.
Maintaining a safe environment and securing pets.
Storing valuables safely (cash, jewelry, electronics, documents, items left openly accessible).
Inform EcoBrightClean about any sensitive surfaces, special materials, or allergies to cleaning products.
EcoBrightClean does not clean areas that are not safely reachable or require moving heavy furniture.
Providing accurate information regarding size and condition of the premises.
If the condition of the premises significantly differs from the Customer’s description, EcoBrightClean may adjust the price or refuse the service.
Accept any additional time or costs resulting from inaccurate or incomplete information.
Delays caused by the Customer reduce the available cleaning time or may result in additional charges.
The Customer is not required to be present during the service; however, access to the property must be ensured at the agreed start time.
EcoBrightClean may, with the Customer’s prior consent, take non-personal before/after photos for documentation and quality control. Photos will never include identifiable persons or personal data.
Excluded Services
Mold removal
Asbestos or hazardous material cleaning
Work requiring elevation above 2 meters
Extreme biohazard or severe unsanitary cleaning
Hoarder / bulk waste removal
Industrial deep cleaning
Window cleaning requiring safety harness equipment
Moving heavy furniture (over 15–20 kg)
Post-construction cleaning only after a mandatory on-site inspection. Final price and scope confirmed after inspection.
Pricing & Payment Methods
All prices include 19% VAT.
Accepted payment methods: online card payment, PayPal, bank transfer, cash, invoice.
Online payments are processed via licensed payment service providers.
Customers must ensure accurate payment information.
EcoBrightClean may adjust prices at any time, but never after a booking is confirmed.
Adjustments due to incorrect Customer information may be applied without prior notice.
For commercial Customers subject to §13b UStG, reverse-charge tax regulations may apply.
Additional Fees
Special cleaning products requested by the Customer.
Extra work due to higher dirt levels.
Travel outside Berlin (shown during booking).
Parking fees if a company vehicle must be used.
Key pickup and return services.
Cancellation, Rescheduling & No-Show
Cancellation Fees: More than 72 hours before appointment: free
72–48 hours before: 25%
48–24 hours before: 50%
Less than 24 hours before: 100%
No-Show Policy: Cleaner waits 30 minutes, rings the bell, and calls the Customer. If access is still not possible → 100% charge.
Cancellations and rescheduling requests are only valid once confirmed in writing by EcoBrightClean via email or message.
Complaints & Re-Cleaning
Complaints must be reported within 24 hours after service completion.
EcoBrightClean reserves the right to provide free re-cleaning.
Re-cleaning must be scheduled within 7 days of the original service date and applies only to the originally booked cleaning scope.
Re-cleaning does not apply to dirt or new contamination occurring after the cleaner has left the premises.
Refunds are only possible if re-cleaning cannot reasonably be performed.
Insurance & Damages
EcoBrightClean holds commercial liability insurance.
Insurance coverage applies to damages from €250 upward.
Damages below €250 cannot be processed through the insurer.
EcoBrightClean is not liable for damage resulting from normal wear and tear, pre-existing defects, improper installation, or items that are already unstable or loose.
All damages must be reported within 24 hours.
EcoBrightClean is not liable for intentional acts of partner cleaners.
Claims are settled directly with the insurance provider.
EcoBrightClean is not responsible for lost keys unless officially handed over and confirmed in writing.
Liability
EcoBrightClean is liable only for intent or gross negligence, breach of essential contractual obligations, and injury to life, body, or health (as required by law).
Liability is limited to typical, foreseeable damages.
No liability for indirect or consequential damages or for damages resulting from inaccurate customer information.
EcoBrightClean is not liable for damages to fragile or loosely installed items such as thin glass shelves, decorative objects, or items that are not securely fixed.
Right to Refuse Service
EcoBrightClean may refuse or discontinue service in cases of unsafe, abusive, or discriminatory behavior.
EcoBrightClean may refuse any task that poses a health, safety, legal, or technical risk to staff or partner cleaners.
Customer Account
The Customer may create an optional account.
Login credentials must be kept confidential.
EcoBrightClean may deactivate accounts in cases of misuse.
Reviews
Customers may submit star ratings after the service.
EcoBrightClean may remove unlawful, offensive, or false reviews.
Reviews may be used for internal quality and service improvement.
Non-Solicitation (Anti-Poaching Clause)
Customers agree not to directly hire, contract, or employ any cleaner assigned by EcoBrightClean for a period of 6 months following the last service.
Data Protection (GDPR)
Personal data is processed in accordance with the GDPR.

Customers have the right to access, correction, deletion, restriction, and data portability.
Force Majeure
EcoBrightClean is not liable for events beyond its control, including: natural disasters, pandemics, war, strikes, power/internet outages, or government restrictions.
Contract Termination
The service contract ends once the cleaning service is completed.
Customer accounts may be deleted at any time.
Governing Law & Final Provisions
German law applies.
Jurisdiction for merchants is Berlin.
Invalid clauses do not affect the rest of the contract.
The German version prevails; this English version is for convenience only.
