I. Preliminary Provisions

1. Preamble

Omaidullah Stanikzai and Samiullah Stanikzai GbR hereafter known as EcoBrightClean Germany contracts for cleaning services, for private and commercial customers, via the website ecobrightclean.de and through EcoBrightClean customer support via email, WhatsApp or telephone. These services are provided by independent service providers assigned by EcoBrightClean or employees of EcoBrightClean.

These Terms of Use govern the customer’s access and usage of the EcoBrightClean Germany platform for sourcing cleaning services in private or commercial environments (Section II). They also cover the terms for booking such services through the Platform and the role of EcoBrightClean Germany in brokering these services (Section III).

While the service contract itself, concluded between customers and service providers, primarily follows statutory regulations and individually negotiated terms, these Terms detail the process for contract formation (Section III.2), the revocation procedure (Section III.7), and the customer’s options for termination (Section IV.2.3).

Any deviation from these Terms requires prior, explicit written consent from EcoBrightClean Germany.

EcoBrightClean Germany offers customers a digital platform designed to help them search for service providers and manage their cleaning service booking requests conveniently.

2. Registration, Contract Formation, and Cost of Use

The User Agreement between the customer and EcoBrightClean Germany comes into effect the moment a customer submits their first booking request, as further outlined in Section III.2.

Access to and usage of the EcoBrightClean platform is entirely free of charge. No fees are incurred for merely browsing the platform or contacting customer service. Charges arise exclusively when a customer books a cleaning service, and these are limited to service-related costs as described in Section III.3.

3. Customer Responsibilities and Service Reviews

When registering, the customer is expected to provide accurate and complete information — including their full name, address, telephone number, email address, and payment details. Should any of this information change during the relationship, the customer must promptly update their account to reflect the new data.

After the service has been completed, customers are invited to rate their experience with Eco Bright Clean by awarding stars. The review may assess the quality of the cleaning, punctuality, professionalism, and overall customer experience. For more detailed feedback, customers are welcome to contact our customer service team at any time via email or WhatsApp.

All reviews must be:

EcoBrightClean Germany reserves the right to remove or withhold publication of reviews that breach these standards. Each review solely reflects the opinion of the customer and not that of EcoBrightClean Germany. Nonetheless, EcoBrightClean actively monitors reviews and addresses any legitimate complaints accordingly.

Upon submitting a review, customers grant EcoBrightClean Germany an irrevocable, royalty-free, perpetual license to use, reproduce, edit, and share the review across various platforms and with third parties.

Please note: Any attempt to manipulate the rating system — such as self-reviews, duplicate reviews, or other forms of distortion — is strictly prohibited.

While EcoBrightClean Germany may consider previous customer ratings when assigning future service providers, it cannot guarantee that a customer’s preferred provider will always be reassigned.

4. EcoBrightClean Germany’s Rights and Obligations; Platform Availability

EcoBrightClean Germany maintains an internal record of all service contracts brokered through the platform and archives invoices for customer access.

We aim to achieve a 95% network availability rate (“connectivity”) for the platform each calendar quarter. However, the following periods are excluded from this calculation and are not deemed service failures:

EcoBrightClean Germany may also temporarily limit platform access outside planned maintenance windows if necessary for security, to preserve network integrity, or to prevent serious operational disruptions. Such interruptions do not entitle customers to any claims.

III. Service and Mediation Agreement

1. Subject Matter of the Agreement

EcoBrightClean Germany facilitates the connection between customers and service providers via the platform, as well as through telephone or email requests. Customers specify the type, scope, and timing of the desired services, and EcoBrightClean Germany matches them with a suitable provider.

Under the standard service model, EcoBrightClean Germany assigns a service provider to a customer’s booking request based on availability and service requirements. While we strive to accommodate customer preferences whenever possible, we cannot guarantee specific provider assignments.

Importantly, the actual Service Contract for cleaning services is exclusively formed between the customer and the selected service provider.

2. Contract Formation and Booking Process

The information displayed on the EcoBrightClean platform is intended as a non-binding invitation to customers to submit booking requests (invitatio ad offerendum). Customers can place a booking either via the platform, by email, or by calling our customer support. The same principles apply across all booking channels.

Booking Process for Standard Services:

  1. Booking Request: Customers initiate a booking by detailing the cleaning service requirements and entering essential personal information, including their address and mobile number.
  2. Review and Payment Details: After clicking “Submit Order,” customers are presented with a summary page displaying the key booking information and associated costs. At this stage, they select a preferred payment method and provide payment details.
  3. Opportunity for Corrections: Up until the final confirmation, customers can review and correct any details or abort the booking process, for instance by simply closing their browser window.
  4. Final Submission: Clicking on the “Book with payment” button constitutes a legally binding offer to procure services as specified.
  5. Order Confirmation: EcoBrightClean Germany sends an automatic acknowledgment email confirming receipt of the booking request. Important: This email does not constitute acceptance of the booking — it simply confirms receipt.
  6. Booking Acceptance: A binding brokerage and service contract is formed only when EcoBrightClean Germany explicitly accepts the booking request by sending a separate email assigning a specific service provider. The booking details, Terms of Use, and cancellation policy are included in this confirmation email.

The customer’s binding contractual partner for the actual cleaning service is the service provider assigned in this confirmation.

3. Pricing and Payment Processing

The prices valid at the time of booking apply both to one-time services and to recurring appointments.

When paying online, the payment is processed independently by the Payment Service Provider under a separate payment service agreement. EcoBrightClean Germany merely facilitates this connection but does not itself handle payments or become a party to the payment process.

By choosing online payment, customers consent to their necessary payment data being transmitted to the Payment Service Provider for transaction purposes.

Customers are obligated to ensure that the agreed service price is fully paid and authorize the Payment Service Provider to collect the relevant amount, which is held in escrow on behalf of the service provider until completion.

Offsetting Claims: Customers may only offset claims against EcoBrightClean Germany if such claims are undisputed or legally upheld.

4. EcoBrightClean Germany’s Responsibilities

EcoBrightClean Germany manages incoming booking requests made through the platform, email, or telephone and forwards accepted requests accordingly. However, EcoBrightClean Germany does not guarantee that every booking request will be accepted.

When selecting service providers, EcoBrightClean Germany considers factors such as location, availability, and service requirements. Although customer preferences may be taken into account, no guarantees are made regarding specific service provider assignments.

Please note: EcoBrightClean Germany is not a party to the Service Contract between the customer and the service provider and, accordingly, assumes no responsibility for the execution or fulfillment of the services.

Should the customer be dissatisfied with a service, EcoBrightClean Germany may, at its sole discretion, offer remedies such as a replacement appointment or a partial refund after an internal review. However, this does not establish a blanket satisfaction guarantee.

5. Insurance

EcoBrightClean Germany maintains a comprehensive liability insurance policy to safeguard customers against potential damages arising during service provision. This insurance covers damages caused by service providers assigned through EcoBrightClean Germany in the performance of their work.

If a customer suffers property damage during a service appointment, EcoBrightClean Germany will assist in reporting the claim to the insurance provider — provided that the claim amount exceeds EUR 250.

6. Cancellations and Rebookings

EcoBrightClean Germany offers flexible rebooking and cancellation options under the following conditions:

These fees compensate for operational disruptions and scheduling losses and do not apply if the cancellation results from force majeure events (e.g., natural disasters, emergencies) or if the original booking was made less than 72 hours before the scheduled service time.

If a booking was placed by EcoBrightClean Germany less than 72 hours before the scheduled start time, the above cancellation fees do not apply.

7. Cancellation Policy (Widerrufsrecht)

Customers who qualify as consumers under applicable laws enjoy a legal right to withdraw from both the brokerage and service contracts under statutory conditions.

Right of Withdrawal
Customers who are consumers under applicable laws have the right to withdraw from both the brokerage agreement and the service contract within fourteen (14) days, without needing to provide any reason.

Consequences of Withdrawal

IV. Common Provisions

EcoBrightClean Germany is not liable for the performance of the service contract by the service provider or for any damages incurred by the customer during the course of the services.

2. Duration and Termination

User Agreement (Platform Use):
The User Agreement between the customer and EcoBrightClean Germany is concluded for an indefinite term upon the customer’s first registration and activation of the platform account. It may be terminated by either party at any time by providing written notice (an email to info@ecobrightclean.de or ecobrightcleangermany@gmail.com is sufficient).

Brokerage Agreement (Booking Mediation):
Each Brokerage Agreement is concluded upon the confirmation of a booking. Separate termination is not necessary. Cancellations and rebookings are subject to Section III.6.

Service Agreement (with Service Provider):
The Service Agreement between the customer and the assigned service provider comes into effect upon notification via email and may be terminated by either party at any time, in accordance with Section III.6.

Termination notices for Service Contracts must also be addressed to EcoBrightClean Germany via the emails listed above.

3. Data Protection

EcoBrightClean Germany processes customers’ personal data strictly in accordance with applicable data protection laws and our Privacy Policy, which is available on our website.

Customers retain rights to access, correct, delete, or restrict the processing of their personal data at any time. By making a booking, customers consent to the processing of their personal data in accordance with Article 6(1)(b) GDPR.

4. Final Provisions

Direct Communication and Promotions:
By submitting a booking request, customers grant EcoBrightClean Germany the right to contact them via email, (with appropriate consent) telephone, or mail during the term of the user agreement and for up to nine months thereafter. We may contact customers regarding platform improvements, news, partnerships, or special offers.

Customers can opt out of receiving such communications at any time by contacting us without incurring additional costs (other than standard transmission charges).

Product Samples:
Occasionally, and within reasonable limits, EcoBrightClean Germany may send customers complimentary product samples. Customers may notify us at any time if they wish to decline such samples.

Contract Language:
The languages available for contract execution are German and English.

Dispute Resolution:

EcoBrightClean Germany is neither obliged nor willing to participate in dispute resolution proceedings before consumer arbitration boards.

Severability:
If any provision of these Terms of Use is or becomes invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

Prohibited Use and Non-Solicitation:
Customers agree not to directly solicit, employ, or engage service providers assigned by EcoBrightClean Germany outside the platform for a period of six (6) months following the last service performed.

Privacy Policy Summary:
EcoBrightClean Germany processes customer data pursuant to Article 6(1) GDPR for the purposes of account management, service fulfillment, communications, and legal compliance. Customers have the right to access, correct, delete, or restrict the processing of their data at any time.

By booking services, customers expressly agree to the data processing terms outlined in the full Privacy Policy.

Jurisdiction and Applicable Law:
This agreement, and any disputes arising from it, shall be governed exclusively by the laws of the Federal Republic of Germany. The exclusive place of jurisdiction for all disputes shall be Berlin, provided the customer is a merchant or otherwise lacks a general place of jurisdiction within Germany.

Force Majeure:
EcoBrightClean Germany shall not be liable for any delay or failure to perform due to events beyond reasonable control, including but not limited to:
